General sales terms and conditions

These sales terms and conditions are agreed between Planète Air SARL, a company with a capital of €40,000, Registration Number 482 549 870 RCS Bordeaux - 21, rue Georges Lesieur - 33300 Bordeaux, hereafter referred to as "Planète Air SARL - LOFTNETS" or "Planète Air EURL", on the one hand, And any individual or legal entity wishing to make a purchase on Planète Air EURL – LOFTNETS’s website, https://www.loftnets.com/, on the other hand, hereafter referred to as "the Customer" or "the Buyer".


1 - Subject and Scope

These sales terms and conditions define contractual relationships between Planète Air EURL - LOFTNETS and the Buyer, together with conditions applicable to any purchase completed through Planète Air EURL - LOFTNETS's retail website, whether the Buyer be a corporation or a private consumer. The purchase of a good or service through this site implies the Customer's unconditional acceptance of these sales terms and conditions.

These conditions of sale apply to the exclusion of all other conditions. They shall prevail over any other general or special conditions not expressly approved by Planète Air EURL - LOFTNETS.

Planète Air EURL - LOFTNETS reserves the right to amend these sales terms and conditions at any time. It is therefore understood that the terms and conditions applicable are those in force on the site at the time of the order by the Buyer on the Site.


2 - Features of Products on Offer

Products and services on offer are those listed on the website: https://www.loftnets.com/.

These products and services are offered within the limits of available stock. Stock is updated on a daily basis. However, there may be occasions when the number of items ordered is greater than the number of products held in stock. Should this occur, the Customer will be notified by email or telephone and Planète Air EURL will state the date when the product will become available.

Site or brochure photographs are as accurate as possible however we cannot guarantee that the product offered will be an identical match, particularly regarding colour.


3 - Price

The prices of our products delivered in Mainland France and Europe are listed in Euros, all taxes included, excluding contribution to processing and shipping costs. The prices of our products delivered in French Overseas Departments and Territories and outside Europe are listed in Euros all taxes excluded, excluding contribution to processing and shipping costs.

The Customer is liable for the payment of applicable VAT and customs duties to local tax and customs authorities. Planète Air EURL - LOFTNETS reserves the right to change its prices at any time, with the understanding that the price listed on the Internet site on the day of the order will the only one that can be applied to the Buyer. Any changes in VAT rate may be applied to the product or service prices. Prices, terms and conditions applicable are those in force on the site on the day of the order.

Unless otherwise stated in quotations, our prices include delivery in Mainland France, in Euros, all taxes included. An estimate of transport costs may be supplied on request.


4 - Orders

A Buyer wishing to purchase a product or service is required to:

  • Complete the identification form on which all requested details should be filled in, together with all necessary details for the delivery. The password for accessing customer's account is strictly private. At each visit, when accessing personal data in a session or ordering, the Customer will have been identified beforehand by entering their user name and password, the latter not being used for payment purposes:
  • Order directly online or confirm by email or print the order form, quoting all the references of the selected products;
  • Confirm the order after verification;
  • Follow conditions provided for the payment.

The confirmation of the order entails agreeing to these sales terms and conditions, acknowledging having full knowledge of them and waiving the right to using their own purchase terms or other terms. All provided information and recorded confirmation will act as proof of the transaction. The confirmation shall serve as signature and acknowledgment of the transaction.

For an order on the website, Planète Air EURL – LOFTNETS will send an email confirming the recorded order. Planète Air EURL – LOFTNETS shall not be held liable or responsible for consequences of any events outside of their control, in particular cases of force majeure, which would delay or prevent the submission of the order online.

Some orders may lead to extra information being requested from the Customer. In this case, the Customer shall be informed by email or telephone of the supporting documents to send to obtain definite confirmation of their order.

Planète Air EURL – LOFTNETS reserves the right to cancel an order if the supporting documents are not received or the documents received are deemed to be non-compliant. The Customer's order may be cancelled by Planète Air EURL – LOFTNETS, for whatever reason, in particular if information required for the delivery is not supplied. The customer will be notified of such a cancellation by Planète Air EURL – LOFTNETS.


5 - Terms of Payment

Purchases made on Planète Air EURL – LOFTNETS’s website will be paid at the time of the order by one of the following methods, at the Buyer's discretion:

  • By credit cards from the CB, VISA and MASTERCARD networks
    Credit card payments are made via the Lyra secure system, which uses the SSL (Secure Socket Layer) protocol, so that information transmitted is encrypted by software and cannot be read by any third party during transport over the network. For any purchase paid by credit card, LOFTNETS integrates the 3D Secure payment security system. 
  • By Paypal
    The Buyer can also opt to pay for the order via the secured payment platform PAYPAL. The Buyer will then be redirected on our Partner's site and will be required to enter his/her password if he/she has a Paypal account. If the Buyer does not have a Paypal account, he/she can create one on the said site. Personal and financial data is encrypted automatically when any sensitive information is sent to Paypal servers.
    PayPal Pay Later (4 times free of charge): available in France (Continental), UK, USA, Spain, Italy.
  • AMEX cards are accepted.

6 - Delivery

General Conditions

The Customer commits to supplying, upon placing the order, all the necessary information to ensure successful delivery. In particular, the Customer shall supply a telephone number which the haulier may use to contact the Customer in daytime hours (land line and mobile). The Customer commits, on his/her behalf or on behalf of the order recipient, to take delivery of the goods at the address given at the time of the order.

At the time of delivery, the Customer or the product recipient should be able, upon request, to offer proof of identity. The Customer commits, after opening and checking the package contents in the presence of the haulier, to sign the delivery note provided by the delivery agent. In the event of damages, non-compliant delivery, failure at the time of unpacking or defective products, refer to clause "Return Management". Delivery does not include product installation.

Delivery time

Design and manufacturing lead times may vary according to the product ordered and the time of year. The usual lead time is 15 working days (excluding summer and holiday periods).

Upon receipt of your order in our logistics warehouse, it will be dispatched within 48 hours.

The delivery time is a maximum of 10 days and refers to working days (Mainland France).

In the event of a foreseeable extension of the delivery time, Planète Air EURL - LOFTNETS undertakes to inform the customer as soon as possible and by any means so that the customer may choose to maintain or cancel all or part of the order.

Under no circumstances may delivery delays result in the payment of damages to the customer or the customer's service providers.

Preparation and shipping costs

For all orders of custom-made nets deliverable in mainland France, at a relay point, Planète Air EURL - LOFTNETS offers free shipping (unless otherwise specified in the quotation and order).

For orders of accessories only (not delivered with a custom-made net), a contribution to shipping costs is added to the order and calculated according to the weight of the parcel.

This amount, fixed according to the nature and quantity of the products, is communicated before final confirmation of the order in the basket. For all destinations other than metropolitan France, shipping costs are communicated before final confirmation of the order.

In the event that a parcel dropped off at a relay point is not collected by the customer within the time limit set by the carrier, resulting in the parcel being returned to the shipping address, Planète Air EURL reserves the right to charge the customer €15 for handling fees.

Deliveries in French Overseas Departments and Territories, and outside EU

Orders to be delivered in a French Overseas Department or Territory or outside EU are invoiced exclusive of taxes, customs duties and VAT. At the time of the delivery, local tax and customs authorities will require:

  • Applicable VAT amount,
  • Dock dues or customs duties (at local authorities' discretion),
  • Customs inspection fees.

These costs are to be paid by the customer, unless otherwise agreed at the time of order.

Possible Delivery Methods

  • CHRONOPOST service: orders weighing less than 30 kg and not exceeding certain dimensions are sent by CHRONOPOST. Delivery is not by appointment. Products are delivered against a signature, or in the event of the customer's absence, the latter is notified by a calling card. Under no circumstances will the parcel be left if the customer is not present to receive it on the day of delivery. This mode of transport is not covered by any insurance.
  • Mondial Relay service
  • Colissimo service against signature or post office delivery
  • Other services such as DHL, Fedex, etc.
For deliveries in the French Overseas Departments and Territories or outside EU, if the price is not calculated and displayed automatically on the site, please contact us directly at contact@loftnet.com to receive a quote.

7 - Managing Returns

Package Undelivered by Haulier

In the event of non-receipt of a package, an investigation will be conducted with the haulier. During this period, no refund or return can be made.

In the event of a confirmed declaration of loss of the parcel by our carrier, depending on the nature of the product and the customer's wishes, we will offer to reship the product initially ordered.

If the customer does not wish to have the product originally ordered resent, a full refund (product(s) + shipping costs) will be made according to the customer's method of payment at the time of ordering.

If non-delivery of a package is a result of the Customer (missed delivery appointment, failure to collect the parcel after a delivery notice, etc.), no refund will be made.

Transport Damage

This clause concerns damaged packages, packages ripped open, missing or damaged products. The Customer shall write his/her claims on the acknowledgment of receipt, sign it, ask the delivery agent for his signature and keep a copy of the document.

If the product is damaged, the Customer must refuse to accept the package and write his/her damage claim on the delivery note (package refused as it was open or damaged at the time of delivery, describing the damage in detail). The claims must be precise. The expression "received pending inspection" is not a claim and has NO LEGAL VALUE. It is imperative to describe in detail the exact condition of the packaging and/or the product and the damage (e.g. sound of broken material, open package, damaged or ripped open packaging, dent in the lower right-hand corner, scratched, dented product, on the right-hand side, refused package as it was open or damaged at the time of delivery, etc.). The Customer must also confirm the claim with the haulier by registered post at the latest within 48 working hours after delivery of the product(s) and send a copy of the letter to:

Please note: Product condition inspection is deemed to be carried out once the delivery note has been signed. Therefore, IF THE AFOREMENTIONED INSTRUCTIONS ARE NOT COMPLIED WITH, NO CLAIM WILL BE ACCEPTED (Article L.133-3 of the French Commercial Code). By signing the delivery note without any precise claims and accepting the products, the Customer acknowledges receipt of the goods in a condition meeting with his/her satisfaction. Any claim thereafter in relation to the condition of delivered products will not be accepted.

After receiving and accepting the package, depending on the nature of the product, available stocks and Customer's requirements, we will offer to reship the product initially ordered.

In the event that the customer does not wish to have the product initially ordered reshipped, a refund will be made according to the customer's method of payment at the time of ordering.

Delivery Non-Compliant with Order Quality or Quantity

The Customer shall send a letter or an e-mail giving details of the conditions of the products received, together with any photos taken. The customer can also contact us by telephone on 00 33 (0)5 35 54 35 00 (cost of a national call depending on operators).

Failure at the Time of Unpacking, Defective Product

The customer shall send a letter or e-mail detailing the condition of the products received and any photos taken.

Any returns made outside this procedure will not be reimbursed.

Products must be returned in their ORIGINAL PACKAGING, in perfect condition, with all accessories and instructions.

Items returned incomplete, damaged, used or soiled will not be accepted and will be returned at the customer's expense. In the event of acceptance of a return, a discount due to the condition of the product(s) may be applied.


8 - Withdrawal

Conditions

In compliance with relevant legal provisions, non-corporate private Buyers have the right to return a product to the Seller up to 14 clear days from the date of delivery for a replacement or reimbursement without penalty.
In compliance with Article L.121-20-2 of the French Consumer Code, this cancellation period does not apply to customised products, made-to-measure to Customer's specifications.
The Customer shall bear the cost of cancellation as described hereafter.

Procedure

Customers must log on to their customer account on the https://www.loftnets.com/ website to exercise their right of withdrawal.

The customer may also notify his decision to withdraw from this contract by means of a clear statement to the following address:

This declaration must state the customer's wish to exercise the right of withdrawal.

The customer is free to choose the mode of return of his product after agreement of Planète air EURL - LOFTNETS and to subscribe or not an insurance in the event of loss, of theft or of destruction of his parcel.

Planète air EURL - LOFTNETS does not assume any of these expenses or the cost of transport and cannot be held responsible for the non-receipt of the customer's package.

In all cases, the customer may be charged €15 (inc. VAT) for processing the return of the order to the logistics center. Furthermore, once the return package has been dispatched, it is IMPERATIVE to send a copy of the return documents. Without this, Planète air EURL - LOFTNETS will not be able to inform the third parties concerned and thus process the return normally.

In the event that the order is not returned as new (i.e. package opened, parts unpacked, parts assembled, item(s) returned uncleaned), DEPRECIATION costs will be charged to the customer.

These DEPRECIATION costs are a maximum of 50% of the order value. Therefore a minimum of 50% of the order shall be reimbursed within 14 days of receipt of the cancellation request. Returned products shall be reviewed with 2 weeks of receiving the return in order to work out the actual amount of the depreciation costs.

After reviewing returned products, if the items are deemed to be fit for resale second-hand, the difference between the product sold as new and the product sold as a second-hand item shall be borne by the Customer and the product's second-hand value shall be reimbursed.

Cancellation Consequences

Ordered product reimbursement shall be made after a maximum of 14 days from the date of withdrawal, if the Customer has complied with the above described return procedure. The reimbursement shall be by the method used for payment of the initial order:

  • In the case of payment by credit card, the refund will be made directly to the customer's credit card account;
  • In the case of payment by cheque, reimbursement will be made by cheque sent to the billing address;
  • In the event of payment by bank transfer, reimbursement will be made by bank transfer, sent to the customer's IBAN;
  • In the case of payment by Paypal account, reimbursement will be made directly to the customer's Paypal account.

The first order shipping costs shall be reimbursed only up to the minimum shipping costs (non-urgent standard shipment). The extra cost of initial express delivery shall not be reimbursed.

If an order of accessories or spare parts is returned in part, returned product outgoing shipping costs shall be reimbursed pro rata of the order total amount and up to minimum shipping costs (non-urgent standard shipment).


9 - Purchases by Non-EU Residents

For any purchase from LOFTNETS where delivery is outside the European Union or in the French Overseas Departments and Territories, the invoice is exclusive of taxes. In such an event, the Customer will be deemed to be the "importer" of the goods. As such, if import taxes or customs duties (they can vary according to location) apply, the Customer (importer) shall bear these costs. If LOFTNETS is not in a position to inform you of the extra costs to pay on delivery, we recommend that you ask the relevant authorities in your country.

Regarding product returns from non-EU countries and French Overseas Departments and Territories, the cost shall be borne by the Customer.

It is also important to note that the warranty remains valid, however the cost of any shipment outside the EU or to the French Overseas Deparments and Territories will be borne by the Customer (transport + customs duties + local taxes).


10 - Warranty

In compliance with the French Consumer Code and consumer rights, subsection 1, articles L217-3 to L217-7, our customers benefit from a legal warranty of conformity for goods, for a period of two (2) years, from the date of delivery of the product.

Planète Air EURL - LOFTNETS provides all their customers with a contractual warranty for each product range. Its duration is stated in the product introduction pages, product sheets, in the “TECHNICAL DETAILS” tab.

This warranty provided by Planète Air EURL - LOFTNETS does not cover:

  • Replacement of parts due to wear and tear: netting, tension ropes, fixings,
  • Corrosion of standard or stainless-steel parts,
  • Fixing’s paint deterioration or fading of netting or tensions ropes,
  • Deterioration of frame pad waterproofing,
  • Fabric, tension rope or net tears,
  • Burns due to cigarettes, barbecue embers, fires, etc…
  • Problems with stitches (boltropes, joints/connections between nets, netting, technical fabric, etc…) if pulled or put under too much tension,
  • Premature wear and tear of tension ropes and netting due to abrasive fixings and/or unsuitable small-diameter tension ropes and/or failure to follow our assembly instructions,
  • Damage due to faulty installation or failure to follow the installation instructions, even if the installation was done by a professional,
  • The customer's express request for resizing a net after order confirmation,
  • Cases of resizing of nets due to the customer supplying fixings without prior validation by Planète Air EURL - LOFTNETS,
  • Abnormal or improper use of the products. In this respect, we invite you to carefully consult the instructions manual provided with the products,
  • Risky behaviour (e.g., hanging from or jumping off netting/technical fabric, wearing shoes, carrying objects that could damage the products, permanent or occasional overloading, etc.). Damage caused by the intervention of a professional not approved by Planète Air EURL - LOFTNETS,
  • Damages resulting from a cause external to the equipment (e.g., accident, impact, falling trees or equipment, damage by animals, lightning, strong winds, storms, tornadoes, frost, heatwave conditions, prolonged exposure to UV light, or other weather conditions, etc.).
  • The characteristics of which the buyer is aware at the time of purchase.
  • For netting, tension ropes and technical fabrics: visual defects such as frayed meshes or knots that do not constitute a manufacturing defect.
  • Chipped paint due to an impact.
  • Traces of dirt on the netting, tension ropes or technical fabrics made during delivery, during installation or when using the products.
  • The use of the products in an establishment open to the public, without prior validation by Planète Air EURL - LOFTNETS and a Control Office.

The implementation of Planète Air EURL - LOFTNETS warranty is applied by replacing or altering, in our workshop, the damaged product deemed by us to be non-compliant, excluding the cost of shipping to and from the Planète Air EURL - LOFTNETS workshop to the customer.

If the product cannot be replaced in an identical manner, Planète Air EURL - LOFTNETS will repair or take back the product or replace it with a product with equivalent characteristics. The contractual warranty does not exclude the provisions of the legal warranty against hidden defects which is valid for a period of 6 months from the date of delivery.

Once we have received this e-mail, we have a maximum of 7 working days to provide you with an answer.


11 - Liability

Planète Air EURL - LOFTNETS, within the scope of online sales, is only liable to an obligation of due care and cannot be held liable for any damages resulting from the use of the Internet, such as data loss, intrusion, virus, service interruption or other involuntary problems. Planète Air EURL - LOFTNETS shall not be held liable for failure to execute the agreed contract due to the occurrence of an event of force majeure, specifically in the event of an total or partial strike by postal services, hauliers and disasters caused by floods or fires, or during a pandemic.

Regarding products bought to meet professional requirements, Planète Air EURL - LOFTNETS shall not be liable for any indirect damages due to these general conditions, loss of service, loss of profit, damages or costs that could be incurred. The Customer has sole responsibility for the selection and purchase of a product. Should it be impossible to use the products fully or in part, particularly due to equipment incompatibility, there shall be no compensation, reimbursement or invoking Planète Air EURL - LOFTNETS liability, except in the event of proven hidden defects, non-conformity, malfunction or exercise of the right to cancel.

12 - Intellectual Property

Planète Air, LOFTNETS and the LOFTNETS logo are registered trademarks in France, Europe and international.

All components of Planète Air EURL – LOFTNETS’s website are and remain Planète Air EURL's exclusive intellectual property.
Any copying, operation, redistribution or use for whatever purpose, in full or partial, of the site components whether it be software, visual or sound bites, is strictly forbidden. The components are subject to copyright laws.
Any copying, republication ou redistribution by any means whatsoever is strictly forbidden by law without Planète Air EURL – LOFTNETS’s written authorisation.


13 - Privacy Policy

In compliance with the French Information Technology, Records and Personal Freedom Law, dated 6th January 1978, Buyers' personally identifiable information may be processed automatically. Customers have the right to access, rectify, delete and port their personal data.

Customer provided information are for the exclusive use of Planète Air EURL - LOFTNETS.

Planète Air EURL - LOFTNETS commits to not passing on personal data provided by site users to third parties. The data is confidential. In addition, users have the right to access and correct data relating to them, in compliance with the 6th January 1978 Law.

As provided for by Law No 78-17 of 6th January 1978 as modified, relating to Information Technology, Records and Personal Freedom, LOFTNETS’s website is subject to a declaration with the National Commission for Data Protection and Liberties (CNIL). Planète Air EURL – LOFTNETS’s client database is registered with the CNIL under number 1410284.


14 - Jurisdiction

These online sales conditions are subject to French law.

In the event of a dispute, the competent courts will be the Bordeaux Courts (33 - Gironde, France). For a professional-to-professional sales contract, the Parties expressly agree that the Vienna Convention cannot be applied to international sales of goods within their relationship. As such, any dispute which has not be resolved amicably will be subject to the exclusive jurisdiction of Bordeaux courts, notwithstanding multiple defendants and/or exposure under warranty, including emergency or preventive action, in summary proceedings or petition.
